Will:

In the Name of God Amen

I, Lorenzo SMITH of the Town of Westbrook in the County of Middlesex & State of Connecticut being of Sound mind and Memory do make and publish this to be my Last will and testament

1st I give and bequeath to my Son Enos SMITH one third of all my Personal Estate of Every name and description that I may Die possessed of, after paying all my Just Debts and funeral Charges

2 I give an bequeath to my Daughter Rachel HAYDEN one third of all my personal Estate, of Every name and description that I may die possessed of, after paying all my Just debts and funeral Charges

3 I give an bequeath to My daughter Nancy KIMBERLY wife of Eli KIMBERLY one third of all my personal Estate of Every name and description that I may Die possessed of, after paying all my Just Debts and funeral Charges

4th I do nominate Constitute and appoint Reuben STANNARD Esq Executer to Execute this my Last Will and testament

In testimony whereof I hereunto set my hand and Seale and publish and decree this to be my Last will and testament in presence of the witnesses named below this first Day of November in the year of our Lord one thousand Eight Hundred & fifty three

Personally appeared Reubin STANNARD, and Richard H. STANNARD and made Solemn oaths that they saw Lorenzo SMITH (the testator) Sign and Seal the within instrument, and heard him publish and declare the same to be his last will and testament, and that they subscribed their names thereto as subscribing witnesses in his presence, and in the presence of each other; and that they verily believe that he was of Sound and disposing mind and Memory before me,

Administrators' Bond:

Know all men by these Presents, THAT we Reubin STANNARD of Westbrook, County of Middlesex, Connecticut as principal, and Charles R. STANNARD of said Westbrook are holden and stand firmly bound and obliged unto Henry M. STANNARD Esq., Judge of the Court of Probate for the District of Westbrook in the penal sum of Five Hundred Dollars; to be paid to said Judge, or to his certain attorney or successors in said office. To the which payment well and truly to be made and done, we the said obligors do bind ourselves and each of us, our heirs, executors and administrators, and each and every of them, for and in the whole, firmly by these presents.-Signed with our hands, and sealed with our seals.

Done in court, at Westbrook the 15th day of July A.D. 1855

THE CONDITION OF THIS OBLIGATION IS SUCH, THAT IF THE ABOVE BOUNDEN Reubin STANNARD Executor to the will of Lorenzo SMITH late of Westbrook in said District, deceased, shall make a true and perfect Inventory of all the Goods, Chattels and Estate of said deceased, which have come, or shall come to his hands, possession or knowledge, or into the hands, or possession of any other person for him and shall exhibit the same into the Registry of the Court of Probate in the District of Westbrook, on or before the 18th day of September next ensuing, and shall well and truly administer the said estate according to law, and make a just and true account of his administration on or before the 18th day of April A.D. 1856 and shall deliver all the residue of the said estate which shall be found remaining upon his said account, the same being first examined and allowed by the Court of Probate, unto such person or persons as said Court, by decree pursuant to law, shall appoint, then this obligation shall be void, otherwise it shall remain in full force.

Bond of the Heirs:

Probate Court, District of Westbrook S.s. Estate of Lorenzo SMITH late of Westbrook in said District deceased. Know all Men by these presents that we Enos SMITH and Rachel HAYDEN of the Town of Westbrook in the County of Middlesex and State of Connecticut, and Eli KIMBERLY and Nancy KIMBERLY his wife of the Town of Guilford County of New Haven in said State are holden and firmly bound and obliged unto Henry M, STANNARD Judge of the Court of Probate for the District of Westbrook in the penal sum of Two Hundred dollars, to the full and just payment of which sum, to be made to said Judge, or to his Attorney or successor in said office, we the obligators above named, do jointly and severally bind ourselves and each of us, our heirs, Executors and Administrators, and each of them, firmly by these presents. Signed with our hands and sealed with our seals, dated at Westbrook this 18th day of February AD 1856

The condition of the above Bond or obligation is such that whereas distribution of the Estate of Lorenzo SMITH late of Westbrook in the District aforesaid and of whose Estate Reubin STANNARD Esq is Executor, has been made to us, in accordance with the last Will and Testament of said deceased, as by said distribution accepted by said Judge of Probate may fully appear, and whereas a debt or debts may hereafter be made to appear against said Estate, and be allowed in due form of law: Now in case any such debt or debts against said Estate shall be hereafter made to appear and be so allowed, and said obligators shall refund to the Executor of said Estate their proportions part thereof and of the charges of said Executor or Administrators then the above obligation to be void and of no effect; otherwise to remain in full force and virtue.
