Possession was not to be had until death of said Thomas Hazard, and then to be for Thmas Sheriff and hsi wife Martha for life, and at death of both to go to second son John Sheriff, and he failing of issue to go to third son, Caleb Sheriff, &c.

"This is to notify all men whom it may anyway concern, whereas ther is apromise of matrimony betwixt Thomas Hazard and Martha Sheriff, yet I, the aforesaid Thomas Hazard, do take the same Martha Sheriff for her own person, without having anything to do with her estate, or anything that is hers for matter of goods," etc.

1676, Nov 13. Will. Exx. wife Martha. To her, 30 acres in Portsmouth for life, as declared in deed to Thomas Sheriff, dated 1666, Dec 10, by which said Thomas Hazard was to have for life and then to my beloved yoke fellow Martha Hazard. To wife also all movable and immovable estate, as housing, goods, cattle and chattels. To son Robert, 1s. To daughters Hannah Wilcox and Martha Potter, wife of Icabod Potter, 1s.
1680. Taxed 9s 6d.

16. Codicil to Will; 6 Aug 1677; Portsmouth, Newport Co., RI 3. Recorded declaration: "that whereas son Robert calims right to my lands by virtue of a writing as he saith by me formerly passed and given to him, &c. -- this is denied. I, Thomas Hazard, do by these presents solemnly protest and affirm that I never made any writing, only in a will drawn by John Porter at John Lawton huose about thirty years past, wherein if I had then deceased, being sick and weak, my said son was to have had my lands and my other children my movables; nor made any writing to said son only in a will 1669, Nov. 30, in which I appointe him executor, since which time have seen cause to make null and void, and do absolutely abolish the two will and have made another will dated 1676, Nov. 6.

Whereas Bethiah Cottrell of South Kingstown, widow & relict of Gershom Cottrell formerly of Kingstown hath made complaint to ye Town Council of South Kingstown that she hath been much abused by her son Stephen Cottrell & his Wife and that she doth daily suffer for lack of food and raiment [p 49] and we duly considering ye evidences do order ye third part of ye real estate that did belong to her siad deceased husband and now in the possession of sd Stephen Cotrell shall be sett of to the said Bethia and take out by the persons hereafter named and they to make their return to ye next Town Council of South Kingstown 8 May 1727. John Tifft, John Shelden, Moses Barber Jr., Samuel Babcock. Rowse Helme Esqr. appointed to go with them.

[p 50] It is the order of this Town Council that the committee which was appointed by the Town Council on the 8 day of May last for to set off one third of the Estate of Gershom Cottrelll Sr. of the late deceased of Kingstown to the widow of said Cottrell for her dowry shall forthwith proceed according to the order of sd Council for the division of sd Estate excepting that Stephen Cottrell who has said estate in his hands shall at or before Thursday next cme and agree with Joseph Sheffield of said town for to allow what said Sheffield shall think proper for the support and maintenance of his Mother and said Sheffield is desired by sd Town Council to go and see what the said widow is in necessity for it being represented to sd Council that she wants relief and that said Stephen Cottrell shall pay the charges.
