Deed from Capt. Jared SPENCER to Robert Lay
Know all men by these presents that I Jared SPENCER of Say-Brook in ye County of New London & Colony of Connecticut in New England for in an Consideration of ye sum of forty five pounds money in hand Received of Robert LAY Jun'r of Say-Brook aforesaid which I do acknowledge myselfe fully satisfied contented & payed have given granted sold & confirmed & do by these presents fully give, grant, sell, convey & confirm unto ye said Robert LAY Jun'r his heirs & assigns this tract or parcell of land lying and being in Oyster River Quarter in ye Township of Saybrook in pachogue which tract of land, contains forty acres more or less being bounded thus westerly partly upon Tho. SPENCER's land and partly upon common land. South East & North upon common land viz: the South west Corner is Chestnut Tree with stons about it from thence Running forty four Rods Eastward to birch Tree with stones about it from thence Running Eighty Six Rods Northward to a birch tree with stones about it from then Running northwest Sixty Rods to a Chestnut tree & stones from thence Running westerly Nineteen Rods & a half to a White oak Tree with stones about it from thence Running Southerly forty Rods to a Walnut Tree, with stones about & from thence Running one hundred & twenty Rods Southerly to ye afore mentioned Chestnut Tree. To Have & to hold ye above grant & bargained premises & ye appurtenances thereunto belonging to ye only proper use benefit & behoof of him ye said Robert LAY Jun'r his heirs & assigns for ever and I the said Jared SPENCER for myself my heirs Executors administrators & assigns Do hereby Covenant promise grant to and with ye s'd Rob't LAY Jun'r his heirs & assigns that at ye ensealing hereof I am ye sole & lawfull owner of ye above bargained premises & have in myself good right & lawfull authority to convey ye same as aboves'd & that hence forth & forever hereafter it may be lawful for the s'd Rob't LAY Jun'r his heirs & assigns by force & vertue of these presents to enter upon have hold use posses & Injoy ye above demised premises & ye appurtenances without any ejectment Desturbance or Incumbrance of Title whatsoever & furthermore I the said Jared SPENCER for myself my heirs executors administrators and assigns Do hereby Covenant Engage that ye above bargained premises to him ye s'd Rob't LAY Jun'r his heirs & assigns against all ye lawfull Claims & Demands of any person or persons whatsoever forever hereafter to warrant Secure & Defend.
In Witness Whereof I have set my hand & seal this 28th day of June 1728.
