Entered Septem'r ye 5th 1728

This agreement made and Concluded between Robert CARTER of Killingworth in the County of Newlondon & Coloney of Conecticut in New England on the one part and his son John CARTER of the afore s'd Killingworth on the other part Witnesseth that the s'd Robert CARTER and John CARTER and & do now stand seized in their propper Right as of fee in Common and undivided of an in a Certain tract of Land formerly belonging to Cap'tt Henry CRANE Late of s'd Killingworth Deseas'd, scituate at a place Called sopus in the township of Killingworth afore s'd, it is now agred betwen the partyes of and in the s'd premises in manner and in form following, and first that the s'd Robert CARTER for him self his heirs and assigns shall from hence forth have hold and peaceably Enjoy in severalty the one half part of the s'd tract of Land on the southeastermost part thereof begining at the southwest Corner at a Chestnut tree marked with H. C running thence northerly forty six Rods to a walnut Bush with stoans Laid about it runing thence Easterly sixty Rods to a walnut Bush stoans Laid about it, runing thence notherly twenty one Rods to a heap of stoans then Easterly sixty rods to a Black oak tree marked with H:C then runing fifty two Rods southerly Cross the meadow Called CRANE's meadow to Saybrook Line then runing west southwest fifty Eight Rods to a Red oak standing by the Brook ,then Runing southwardly twenty Eight Rods & a half to a white oak tree marked with H:C then Runing westerly sixty two Rods to the first mentioned Chestnut tree marked H:C: and that the s'd John CARTER nor his heirs shall not from henceforth claime or Demand any Right title or Interest in or to the same or any part there of but that the s'd John CARTER his heirs Executors & Administrators shall be utterly Excluded and forever debared by these presents and that the s'd John CARTER his heirs and assign shall from hence forth have hold and peaceably Enjoy in severally to him the s'd John CARTER his heirs and assigns forever to his and their own propper use and behoof the other half part of ye s'd tract of Land lying northwesterly of ye s'd Robert CARTER's half of s'd Tract of Land so that the s'd Robert CARTER nor his heirs shall not from henceforth any waies Claime Challeng or Demand the same or any part thereof but he the s'd Robert CARTER his heirs Executors Administrators and Every of them shalt be utterly Excluded and forever Debared by these presents & for the Confirmation of the above written agreement of partition the above named Robert CARTER and John CARTER have hereunto set their hands and seales this thirty first Day of August Anno=Dominie 1728
