To all Christian People to whome these presents shall Come Greeting Know ye that I Robert CARTER of Killingworth in the County of Newlondon and Coloney of Conecticut In New England for Divers Good Causes and Considerations me there unto moveing Have Given Granted Bargained sold alliened Convey and Confirmed to my son Samuel CARTER of the above s'd: Town County and Coloney and Do by these presents fully freely and absolutly Give Grnt Bargain sell Allien Convey and Confirm unto him the s'd Samuel CARTER his heirs and assigns forever the third part of Each of these tracts or parcells of Land hereafter mentioned Imprimes a Certain tract of Land scituate in Killingworth above s'd lying at the place Called sopus which description is as followeth: begining at the south west Corner at a Chestnut tree marked with H.C thence northerly forty six Rods to a walnut bush with stoans Laid about it thence eastward sixty Rods to a walnut Bush stoans laid about it thence northwardly twenty one Rods to a heap of stoans thence Eastwardly sixty Rods to a Blackoak tree marked with H C: thence fifty two Rods southwardly Cross meadow Called CRANE's meadow to Saybrook line thence southwest fifty Eight rods to a Red oak stadle by the Brook thence southwardly twenty Eight Rods and an half to a white oak tree marked with H:C: thence westwardly sixty Rods to ye first mentioned Corner Containing thirty Eight acres Bounded westwardly by highway northwardly by John CARTER's Land Eastwardly by ye Land of Lieut't Joseph KELCEY southerly by the highway and Common Land also a tract of Land in Killingworth above s'd lying near the above described Land in Breadth sixteen rods in length on the Eastwardly side thirty three Rods and a quarter on the westerly side thirty three Rods the Boundaryes of Each Corners are heaps of stones Bounded northerly by the highway other waies by the Comon Containing three acres and a quarter and Eleven Rods, Also a piece of Land in s'd Killingworth lying near the meadow Called CRANE's the northwarly Corner is a Black oak tree marked thence southwardly Eight Rods and a quarter to a Beach tree marked thence Eastwardly to a red oak tree marked and so proceeding Eastwardly till it Come to the line between Saybrook and Killingworth and there two rods and a quarter in Breadth containing two acres more or less Bounded northwardly and westwardly by the Land Which I purchased of ye hereof Cap't Henry CRANE deseased, Eastwardly by ye Dividin Line between Killingworth and say brook southwardly by the Land of Lieu'tt Joseph KELCEY To Have and To Hold the one third part of Each of above described parcells of Land (ye first above Described Land to be so divided as that it shall ?tude the one third part of the fruit trees now standing there on and the one half of the Delling house there on standing which third part is to be taken from the west side of s'd Land) together with the one half of ye above s'd dwelling house and the above s'd third part of the fruit trees together with ye one third part of the sawing mill standing in the ? of the first Described piece of Land with the appurtenances privilidges Comoditied and ? Comon or undivided Land to the same belonging or in any wise appertaining to him the s'd Samuel CARTER his heirs and assigns forever to his and their only proper use benifit and behoof forever and I the s'd Robert CARTER for my self my heirs Executors and Administrators Do Covenant promise and Grant to and with the s'd Samuel CARTER his heirs and Administrators Do Covenant promise and Grant to and with the s'd Samuel CARTER his heirs and assigns that before the Ensealeing here of I am the true sole and Lawfull owner of the above Granted and bargained premises with the appurtenances privilidg Comodities and Rights in Common to the same belonging and have in my self Good Right full power and Lawfull authority to sell the same in maner of above s'd and that the s'd Samuel CARTER his heirs and assigns shall and may from time to time and at all times forever here after by force and virtue of these presents Lawfully peaceably and quietly Have Hold use occupie possess and Enjoy the same free and Clear freely and Clearly acquitted Exonerated and discharged of and from all and all manner of former or other Gifts Grants Bargains sales or Incumbrances in the Law whatsoever furthermore I the s'd Robert CARTER for my self my heirs Executors and administrators Do Covenant and Engage the s'd Granted and Bargained premises to him the s'd Samuel CARTER his heirs and assigns against ye Lawfull claimes or Demands of any person or persons whomsoever forever here after to warrant secure and defend In witness whereof I the s'd Robert CARTER have here unto set my hand and seale this thirtyeth Day of August Anno=Dominie one thousand seven hundred and twenty Eight and in the second year of the Reign of our Sovereign Lord George the second King of Great Brittain &c
