Indenture Between Robert CARTER and John BROOKER
October 17, 1716
This indenture made the sixteenth Day of October in ye third year of the Reign of our Sovereign Lord George King of England &c Between Robert CARTER of East Guilford in the county of New Haven & Coloney of Connecticut Carpender, on the one part and John BROOKER of Killingworth in ye County of New London & Coloney afores'd, shipright, on the other part [?] that I the s'd Robert CARTER for divers good causes & considerations me there unto moveing have given, granted, bargained, sold, Allienated, Conveyed & Confirmed, and by these presents Doe fully, freely, and also fully give, grant, bargain, sell, alien, Convey & Confirm unto him the s'd John BROOKER his heirs & assigns forever, a certain parcell or Tract of home Lott Land Scituate leing & being in the Town of Killingworth afores'd being in length thirty Rods in Breadth twenty two rods, Containing four acres more or less, Bounded Easterly by the indian River westerly by the Land of Samuell STEVENS deseased, northerly by the Land of Josiah STEVENS & southerly by the highway or Country Road, To Have and to Hold the above granted and Bargained Land with the dwelling house, yards, fences and fruit trees thereon being of what sort of improvement soever, together with all the appurtenances, priviledges, Right in Commons or other Divisions whatsoever thereunto belonging or any waies appertaining to him the said John BROOKER his heirs and assigns forever & I the s'd Robert CARTER for me, my heirs, Executors, Administrators Doe Covenant Grant promise to & with the s'd John BROOKER his heirs & assigns that before the Ensealing of these presents I am the true sole & Lawfull owner of the above granted & bargained premises, and have in my self good Right full power and Lawfull authority to Bargain & Sell the same in manner of above s'd & that the s'd John BROOKER his heirs & assigns shall may from time to time & at all times forever hereafter by force & virtue of these presents Lawfully peaceably and quietly, Have, Hold, use, occupie, possess & Injoy the above granted & bargained premises with the appurtenances free & clear, freely and clearly acquired Exonerated & discharged of & from all & all manner of other & former gifts, grants, mortgages, wills, jointers, Dowries, Intails or incumbrances in the Law what soever; More over I the s'd Robert CARTER for me my heirs Executors, Administrators Doe Covenant & Ingage the above granted & Bargained premises to him the s'd John BROOKER his heirs and assigns against all Lawfull Claims or demands of any person or persons whosoever to warrant secure & Defend, provided ?ever the Less and it is the true Intent & meaning of both persons above names that to say the grantor & grante in & by these presents any thing herein Contained not with standing that if the above named Robert [blackened film] administrators or assigns [blackened film] payed to the above named [blackened film] the full and ? [blackened film] ?yed in Killingworth at [blackened film] ?ment to be paid on or before the fourteenth day of ?ber, next insueing the Date here of to be ten pounds, and to be payed in currant money of the Coloney afores'd, the second payment to be in the like Current money & to be payed on or before, the fourteenth Day of October in the yeare one thousand seven hundred & Eighteen s'd payment to be twenty pounds, the third payment to be twenty pounds in the Current money & to be payed on or before the fourteenth day of October in the yeare one thousand seven hundred & Nineteen, the fourth payment to be twenty pounds, in like current money and to be payed on or before the fourteenth Day of October in ye yeare one thousand seven hundred & twenty, the fiveth payment to be twenty pounds in like current money & to be payed on or before the fourteenth day of October in the yeare one thousand seven hundred & twenty one the sixth and Last payment of the said hundred & ten pounds to be twenty pounds, in like Currant money and to be payed on or before the fourteenth day of October in the year one thousand seven hundred & twenty two without fraud or Coven, then this above written Deed or obligation and Every Claus and article therein contained shall be null voic & of none Efect, or else shall abide in full force and vertue in full power force and vertue in witness where of I the above named Robert CARTER have Sette my hand & seal the day and yeare above written, Annodomin seventeen hundred & sixteene
